Terms and Conditions

These Terms and Conditions ("Terms") govern your use of VisaAssistants (the "Service"), operated by VisaAssistants LLC. By using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Provider Disclosure
VisaAssistants is a private commercial assistance service. We are not affiliated with the United States Government, the Department of Homeland Security, US Customs and Border Protection (CBP), or any other government agency. The official ESTA application website is esta.cbp.dhs.gov, where applicants may apply directly without our assistance for the official government fee only.
2. Service Description
We provide a paid assistance service for travellers applying for the US Electronic System for Travel Authorization (ESTA). Our specialists review the information you provide, prepare the application and submit it to CBP on your behalf. We do not issue the travel authorization itself — only US authorities can grant or deny ESTA.
3. Pricing
The total fee at checkout includes our service fee ($69.00) and the official US Government fee ($40.27). The government fee is paid through us to CBP. The service fee is payable to us for the work described above.
4. Electronic Communications
By using the Service you consent to receive transactional and informational communications from us by email, including order confirmations, status updates, receipts, requests for additional information and refund notifications. You agree that all required notices, agreements and disclosures may be delivered electronically.
5. Accuracy of Information
You agree to provide complete, accurate and truthful information when using the Service. You are solely responsible for the accuracy of every piece of data submitted, including names, passport details, travel plans and answers to eligibility questions. Inaccurate information may result in denial of entry to the United States, for which we are not liable.
6. Third-Party Authorisation
If you submit information about another person (for example a family member or travel companion), you confirm that you have their permission to share their personal data with us and to authorise us to submit it to CBP on their behalf.
7. Electronic Records and Signatures
Records of your application, payment and correspondence are retained electronically. Clicking "I accept", "Confirm", "Pay" or any equivalent button constitutes a legally binding electronic signature equivalent to a handwritten signature where permitted by applicable law.
8. Non-English Speakers
While our interface and support may be offered in multiple languages, the official ESTA application is processed by US authorities in English. You are responsible for confirming that the information submitted in English on your behalf accurately reflects your situation.

10. Third-Party Services
The Service relies on third-party providers (payment processors, email and hosting providers, and the official CBP system). We are not responsible for outages, errors or delays caused by third parties beyond our reasonable control.
11. Limitation of Liability
We do not guarantee approval of your ESTA. The decision is made entirely by US authorities. To the maximum extent permitted by law, our total liability arising from or related to the Service is limited to the amount you paid us as a service fee for the application in question. We are not liable for indirect, incidental, consequential or special damages, including missed flights, lost profits or non-refundable travel bookings.
12. Indemnification
You agree to indemnify and hold harmless VisaAssistants LLC, its officers, directors, employees and agents from any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of: your breach of these Terms; your misuse of the Service; or your violation of any law or third-party rights.
13. Right to Refuse Service
We reserve the right, in our sole discretion, to refuse, suspend or terminate your access to the Service at any time, including where we suspect fraud, abuse, illegal activity, breach of these Terms or excessive chargebacks. In such cases we may refund any unused service fee.
14. Force Majeure
We are not liable for failure or delay in performance caused by events beyond our reasonable control, including natural disasters, war, terrorism, government actions, network or infrastructure outages, pandemics, or service disruptions affecting CBP, payment processors or other third parties.
15. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
16. Dispute Resolution and Arbitration
Any dispute, claim or controversy arising out of or relating to these Terms or the Service shall first be addressed by good-faith negotiation. If not resolved within 30 days, the dispute shall be settled by binding arbitration administered by a recognised arbitration body, conducted in English, in the State of Wyoming. Either party may seek injunctive relief in a court of competent jurisdiction for protection of intellectual property or confidential information.
17. Class Action Waiver
You and VisaAssistants LLC agree that any dispute will be resolved on an individual basis. Neither party may participate in a class action, class arbitration or consolidated proceeding. Where a court finds this waiver unenforceable, the entire arbitration provision in Section 16 shall be unenforceable.
18. Time Limit for Claims
Any claim against us must be brought within one (1) year after the cause of action arises, otherwise it is permanently barred, except where applicable law requires a longer period.
19. Reviews and Testimonials
If you submit a review, testimonial or other feedback, you grant us a non-exclusive, royalty- free, perpetual licence to use, reproduce and display it for marketing purposes, with or without attribution.
20. Changes to These Terms
We may update these Terms from time to time. The updated version takes effect when posted on this page. Material changes will be notified by email where reasonably possible. Continued use of the Service after a change constitutes acceptance of the new Terms.
21. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
22. Acknowledgment
By using the Service you acknowledge that you have read these Terms, understand them and agree to be bound by them.
